El perjuicio al fisco en la aplicaci贸n del principio de proporcionalidad en materia tributaria. El caso de la Infracci贸n tipificada en el numeral 1 del art铆culo 176 del C贸digo Tributario
La potestad sancionadora de la Administraci贸n requiere estar sujeta a garant铆as
m铆nimas que protejan los derechos fundamentales de los administrados, dentro de ellas
encontramos al principio de proporcionalidad. Este 煤ltimo exige que la intensidad de la
sanci贸n encuentre una relaci贸n razonable con la gravedad de la lesi贸n provocada al
bien jur铆dico tutelado. El presente trabajo tiene como objetivo estudiar a las infracciones
tributarias desde su afectaci贸n al bien jur铆dico de recaudaci贸n tributaria. Luego del
an谩lisis de legislaci贸n, jurisprudencia y doctrina nacional y extranjera se evidencia que
existen infracciones que inciden directamente en ese bien jur铆dico, como aquella
tipificada en el numeral 1 del art铆culo 176 del C贸digo Tributario. As铆, se concluye que la
sanci贸n vinculada a dicha infracci贸n requiere ser modificada para resultar proporcional
al perjuicio generado al fisco.The sanctioning power of the Administration requires to be subject to minimum
guarantees that protect the fundamental rights of the citizens, among them we find the
principle of proportionality. The latter requires that the intensity of the sanction be
reasonably related to the severity of the harm caused to the protected legal asset. The
purpose of this thesis is to study tax offenses from the perspective of their impact on the
legal asset of tax collection. After the analysis of legislation, jurisprudence and national
and foreign doctrine, it is evidenced that there are offenses that directly affect this legal
asset, such as the one typified in paragraph 1 of article 176 of the Tax Code. Thus, it is
concluded that the sanction related to that infraction needs to be modified in order to be
proportional to the damage caused to the treasury
Conventionality control in public administration: a mechanism in defense of taxpayers
With the sentence 04293-2012-PA/TC, the Constitutional Court revoked the binding precedent that validated the application of a constitutionality control by the administrative jurisdiction. Thus, taxpayers face a situation of defenselessness against the potential application of unconstitutional tax laws. While there are alternative ways for taxpayers to defend themselves against these laws, they are not equally suitable to protect their interests and lack the promptness that characterized the constitutionality control performed by the Public Administration.
In this article, the authors propose the application of conventionality control by the Public Administration as an alternative solution that safeguards the fundamental rights of taxpayers with an immediacy similar to that allowed by constitutionality control.A trav茅s de la sentencia reca铆da en el expediente 04293-2012-PA/TC, el Tribunal Constitucional dej贸 sin efecto el precedente vinculante que validaba la aplicaci贸n del control difuso en sede administrativa. Esto supuso para los contribuyentes una situaci贸n de indefensi贸n frente a la potencial aplicaci贸n de normas tributarias inconstitucionales. Si bien existen v铆as alternativas para que estos puedan defenderse ante estas normas, estas no resultan igualmente id贸neas para tutelar sus intereses y carecen de la rapidez que caracterizaba al control difuso en sede administrativa.
